SugarBee® Apples Privacy Policy

This Privacy Policy (“Policy”) applies to sugarbeeapple.com and ALTAFRESH, LLC (“Company,” “we,” “us,” or “our”) and governs data collection and usage. For purposes of this Policy, unless otherwise noted, all references to the Company include sugarbeeapple.com. The Company’s website is a news, information, and consumer engagement site that may, from time to time, offer email newsletters, text message programs, sweepstakes, recipes, and related promotional content. By using the Company website, services, email programs, or text messaging programs, you consent to the data practices described in this Policy.

Collection of your Personal Information

We do not collect personal information about you unless you voluntarily provide it. You may be asked to provide certain personal information when you elect to use certain features, products, or services, including:

  • Registering for an account or subscribing to email or text messaging programs;
  • Entering a sweepstakes, contest, or promotion sponsored by us or one of our partners;
  • Signing up for special offers from us or selected third parties;
  • Sending us an email, contact form submission, or other inquiry;
  • Submitting a mobile phone number to receive text messages from us; and
  • Submitting payment information when ordering or purchasing products or services.

We will use the information you provide to communicate with you about services and products you have requested and to operate, improve, and personalize the Company’s programs and offerings. We may also gather additional personal or non-personal information in the future to the extent permitted by law.

Text Messaging (SMS/MMS) Program

The Company may offer SMS and MMS text messaging programs (the “SMS Program”) that allow you to receive marketing messages, recipe ideas, promotional offers, sweepstakes notifications, shopping reminders, and other communications from SugarBee® Apples on the mobile phone number you provide.

How We Collect Your Phone Number

We collect your mobile phone number only when you affirmatively opt in to the SMS Program — for example, by entering your number into a sign-up form on our website, completing a sweepstakes or contest entry that includes SMS opt-in language, replying to a confirmation message, or otherwise providing express written consent. By opting in, you agree to receive recurring automated marketing and informational text messages from SugarBee® Apples at the number provided. Consent is not a condition of any purchase. Message and data rates may apply. Message frequency varies.

How We Use Your Phone Number

We use the mobile phone numbers we collect through the SMS Program to:

  • Send you marketing, promotional, and informational text messages about SugarBee® Apples products, recipes, retail availability, sweepstakes, and events;
  • Send transactional or service messages, such as order, shipping, sweepstakes entry, or customer-support related notifications;
  • Send shopping cart reminder messages (see “Abandoned Cart Text Messages” below);
  • Verify your identity, manage your subscription, respond to HELP and STOP requests, and otherwise administer the SMS Program; and
  • Maintain records of your opt-in, opt-out, and consent for legal and compliance purposes.

Who We Share Your Phone Number With

We share the phone numbers and related information collected through the SMS Program only with the service providers that help us operate the program — for example, our SMS platform provider (such as Klaviyo), telecommunications carriers required to deliver the messages, and customer-support, analytics, fraud-prevention, and IT vendors acting on our behalf. These service providers are contractually required to protect your information and to use it only to provide services to the Company.

We do not sell, rent, lease, or share your mobile phone number, text messaging opt-in data, or SMS consent with any third parties or affiliates for their own marketing purposes. Mobile information will not be shared with third parties or affiliates for marketing or promotional purposes. All categories of information described in this Policy exclude text messaging originator opt-in data and consent; this information will not be shared with any third parties.

Opting Out and Getting Help

You can cancel the SMS Program at any time by texting “STOP” to the originating short code or phone number. After you send the message “STOP” to us, we will send you a confirmation message and you will not receive additional messages from us unless you opt in again. For help, text “HELP” to the same short code or phone number, or contact us using the information in the “Contact Information” section below. Carriers are not liable for delayed or undelivered messages.

Abandoned Cart Text Messages

SugarBee® Apples’ website uses cookies, web beacons, pixels, tags, and similar technologies (including those provided by our marketing platform, Klaviyo) to help keep track of items you place into your shopping cart, including when you have abandoned your cart without completing checkout. This information — including your cart contents, browsing activity on the site, and the email address or mobile phone number you have voluntarily provided — is used to determine when to send you cart reminder messages by email and, if you have opted in to our SMS Program, by text message.

You will only receive abandoned cart text messages if you have separately and affirmatively opted in to receive marketing text messages from us. You can stop receiving these reminder messages at any time by replying “STOP” to any text message we send, by unsubscribing from the email link, or by contacting us using the information in the “Contact Information” section.

Sharing Information with Third Parties

The Company does not sell, rent, or lease its customer lists to third parties.

The Company may share data with trusted partners and service providers to help perform statistical analysis, send you email or postal mail, deliver text messages on our behalf, host our website, process payments, provide customer support, fulfill orders, or arrange for deliveries. All such third parties are prohibited from using your personal information except to provide these services to the Company, and they are required to maintain the confidentiality of your information.

The Company may disclose your personal information, without notice, if required to do so by law or in the good-faith belief that such action is necessary to: (a) conform to the edicts of the law or comply with legal process served on the Company or the site; (b) protect and defend the rights or property of the Company; and/or (c) act under exigent circumstances to protect the personal safety of users of the Company or the public.

The above categories of data sharing exclude text messaging originator opt-in data and consent; this information will not be shared with any third parties. Mobile phone numbers obtained through the SMS Program, along with related opt-in records, are not shared, sold, rented, leased, or otherwise disclosed to any third party or affiliate for marketing or promotional purposes.

Automatically Collected Information

The Company may automatically collect information about your device and browsing activity when you visit our website. This information can include your IP address, browser type, operating system, device identifiers, domain names, access times, pages viewed, items added to or removed from your shopping cart, referring website addresses, and similar usage information. We use this information to operate and maintain the website, improve quality and performance, deliver relevant content (including, where you have opted in, abandoned cart and other reminder communications), and produce general statistics about site usage.

Cookies and Similar Technologies

Our website uses cookies, pixels, web beacons, tags, local storage, and similar tracking technologies, including those provided by analytics and marketing partners such as Google Analytics and Klaviyo. We use these technologies to:

  • Recognize you when you return to the site and remember your preferences;
  • Track the items you place in your shopping cart and detect when a cart has been abandoned, so we can send the cart reminder communications described above;
  • Understand how visitors use the site, measure performance, and improve our content and offerings; and
  • Deliver relevant marketing communications by email or, where you have opted in, by text message.

Most browsers allow you to refuse or delete cookies through your browser settings. If you disable cookies, some features of the site — including the shopping cart and our ability to send you cart reminders — may not function properly.

Location Information

The Company does not use GPS, precise geolocation, or location-based services to track your real-time location. We do not collect precise location information from your mobile device, and we do not use location data to send location-triggered text messages or marketing communications.

We may, however, derive approximate, non-precise location information (such as city, region, or country) from your IP address or from information you voluntarily provide (for example, a ZIP code entered into a store-locator tool or a shipping address provided at checkout). This approximate location information is used solely to:

  • Help you find retailers that carry SugarBee® Apples;
  • Calculate shipping, taxes, and applicable promotions;
  • Tailor content (such as recipes or seasonal availability) to your general region; and
  • Produce aggregated, de-identified analytics about how our site is used.

We do not share your location information with third parties for their own marketing purposes.

This website contains links to other sites. Please be aware that we are not responsible for the content or privacy practices of such other sites. We encourage our users to be aware when they leave our site and to read the privacy statements of any other site that collects personally identifiable information.

Security of your Personal Information

The Company secures your personal information from unauthorized access, use, or disclosure. The Company uses the following methods for this purpose:

  • SSL/TLS Protocol: When personal information (such as a credit card number or mobile phone number) is transmitted to or from our website, it is protected through the use of encryption, such as the Secure Sockets Layer (SSL) / Transport Layer Security (TLS) protocol.
  • Vendor controls: We require our service providers (including our SMS platform) to implement reasonable administrative, physical, and technical safeguards.

We strive to take appropriate security measures to protect against unauthorized access to or alteration of your personal information. Unfortunately, no data transmission over the Internet or any wireless network can be guaranteed to be 100% secure. As a result, while we strive to protect your personal information, you acknowledge that: (a) there are security and privacy limitations inherent to the Internet that are beyond our control; and (b) the security, integrity, and privacy of any and all information and data exchanged between you and us through this site cannot be guaranteed.

Right to Deletion

Subject to certain exceptions set out below, on receipt of a verifiable request from you, we will:

  • Delete your personal information from our records; and
  • Direct any service providers to delete your personal information from their records.

Please note that we may not be able to comply with requests to delete your personal information if it is necessary to:

  • Complete the transaction for which the personal information was collected, fulfill the terms of a written warranty or product recall conducted in accordance with federal law, and provide a good or service requested by you, or reasonably anticipated within the context of our ongoing business relationship with you, or otherwise perform a contract between you and us;
  • Detect security incidents, protect against malicious, deceptive, fraudulent, or illegal activity, or prosecute those responsible for that activity;
  • Debug to identify and repair errors that impair existing intended functionality;
  • Exercise free speech, ensure the right of another consumer to exercise his or her right of free speech, or exercise another right provided for by law;
  • Comply with the California Electronic Communications Privacy Act;
  • Engage in public or peer-reviewed scientific, historical, or statistical research in the public interest that adheres to all other applicable ethics and privacy laws, when our deletion of the information is likely to render impossible or seriously impair the achievement of such research, provided we have obtained your informed consent;
  • Enable solely internal uses that are reasonably aligned with your expectations based on your relationship with us;
  • Comply with an existing legal obligation; or
  • Otherwise use your personal information, internally, in a lawful manner that is compatible with the context in which you provided the information.

Children Under Thirteen

The Company does not knowingly collect personally identifiable information from children under the age of 13. If you are under the age of 13, you must ask your parent or guardian for permission to use this website. The SMS Program is not directed to, and we do not knowingly enroll, individuals under the age of 13 (or under the minimum age required by applicable law in your jurisdiction).

Email Communications

From time to time, the Company may contact you via email for the purpose of providing announcements, promotional offers, alerts, confirmations, surveys, and other general communications. In order to improve our services, we may receive a notification when you open an email from the Company or click a link within it.

If you would like to stop receiving marketing or promotional communications via email from the Company, you may opt out of such communications by clicking the “Unsubscribe” link in any marketing email or by contacting us at the address below.

Changes to This Policy

The Company reserves the right to change this Policy from time to time. For example, when there are changes in our services, changes in our data protection practices, or changes in the law. When changes to this Policy are significant, we will inform you. You may receive a notice by email at the primary address associated with your account. We may also notify you by a prominent notice on our SUGARBEE® APPLE website and/or by updating any privacy information. Your continued use of the website and/or services available after such modifications will constitute your: (a) acknowledgment of the modified Policy; and (b) agreement to abide and be bound by that Policy.
